AGREEMENT TO OUR TERMS
Welcome to American Standard Typing Certificates™ ("Company", "we", "our", or "us"). These Terms and Conditions ("Terms") govern your use of our website located at www.americanstandardtypingcertificates.com (the "Site"), our online testing platform, and any related services (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with these Terms, you are expressly prohibited from using the Services and must discontinue use immediately. Please read these Terms carefully before using our Services.
These Terms are version controlled. Each published version carries a version number, shown at the top of this page, and the same version is published on our website and presented on our platform. When you first sign in to the platform, your acceptance of the current version of these Terms and of our Privacy Policy is recorded, together with the version number of each document and the date and time of acceptance. We may update these Terms from time to time. When we make material changes, we will update the Last Updated date and the version number at the top of this page, and you will be asked to review and accept the updated version when you next sign in to the platform. Your continued use of the Services following the posting of non material changes constitutes your acceptance of the revised Terms.

1. OUR SERVICES
American Standard Typing Certificates™ provides online typing tests and certificates that measure typing speed and accuracy. Certified assessments are completed on our platform ("Main Tests") and are designed to be completed under webcam proctoring. Practice exercises are also available ("Practice Tests") and are not proctored. Each Main Test produces a three page certificate comprising the certificate itself, a performance transcript reproducing the text typed and a proctoring summary page (the "Virtual Proctoring Summary") recording how many webcam snapshots were captured during the test. Certificates carry a unique certificate ID, a QR code and a verification link through which third parties may confirm the result against our records. The public verification page displays your name, scores, test date, test type, certificate ID and snapshot proctoring status (how many webcam snapshots were captured), and is accessible to anyone who holds the verification link or scans the QR code. Our certificates can be used for job applications, resumes and other professional purposes.
Services are sold as test packages. Each package includes a fixed number of Main Test subscriptions as described at the point of purchase, together with unlimited Practice Tests. Each commenced Main Test consumes one subscription. Practice Tests are not proctored, do not produce certificates and their results are not saved. Our Services are intended for use by working age adults for professional and employment related purposes. All personal data collected in connection with the Services is used to administer and verify your typing assessment and to maintain your account, as described in our Privacy Policy.
2. ELIGIBILITY
By using our Services, you represent and warrant that you are at least 18 years of age. Persons under the age of 18 are not permitted to use or register for the Services. By proceeding to use the Services, you confirm that you meet this age requirement. If we become aware that a user is under the age of 18, we will terminate their account and delete any associated personal data as promptly as possible.
3. USER ACCOUNTS
Account Creation: your account is created automatically from the details you provide at purchase. You agree to provide accurate and complete information, including your full legal name, which will appear on any certificate issued to you.
Account Access: access to your account is provided through secure magic link sign in sent to your registered email address. We do not create or store passwords for your account. You are responsible for maintaining the security of that email account, and all activity occurring through sign in links sent to it is your responsibility.
Account Security: you agree to notify us immediately of any unauthorized access to or use of your account at info@americanstandardtypingcertificates.com.
4. PAYMENT AND FEES
Purchasing: purchases are made through our regional online store, and your platform account is provisioned automatically following purchase.
Accepted Payment Methods: we accept payment through the payment processors identified at checkout, which include Stripe, covering Visa, Mastercard, American Express, Discover, Apple Pay and Google Pay, and PayPal.
Pricing: all prices are listed in U.S. Dollars (USD) and are subject to change without notice. Where sales tax applies to your purchase, it is calculated and shown at checkout.
Payment Processing: payment transactions are processed directly by our payment processors. We do not store payment card information in our own systems. By providing payment information, you represent and warrant that you are authorized to use the designated payment method.
5. REFUND POLICY
At American Standard Typing Certificates, customer satisfaction is our priority. Refund requests are handled professionally by our support team.
Refund Eligibility: we consider reasonable partial or full refund requests on a case by case basis.
Refund Requests: to request a refund, contact us at info@americanstandardtypingcertificates.com within 14 days of your purchase.
Digital Products: due to the digital nature of our products, refunds may not be available for Main Tests that have been completed or for packages where certificates have been issued.
6. TEST INTEGRITY AND WEBCAM PROCTORING
Webcam proctoring supports the integrity and value of the certificates we issue. By commencing a Main Test you agree to the following:
Webcam Access: Main Tests are designed to be completed under webcam proctoring, and we strongly recommend using a working camera so that your proctoring summary is complete. Before each Main Test you will be shown a consent notice and, where a camera is available, a live preview. A working webcam is not required to begin a Main Test. If you decline consent or your camera is unavailable, the Main Test will still proceed, one Main Test subscription will still be used, and the Virtual Proctoring Summary on your certificate will record that no snapshot was captured at the affected capture points. Practice Tests do not involve the webcam.
Proctoring Images: where you consent and a camera is available, up to three still images are captured by your webcam during your Main Test session ("Proctoring Images"), at the start of the test, at the midpoint and at the end of the test. Proctoring Images form part of your test record and appear on the Virtual Proctoring Summary page of your certificate, which records how many were captured. Proctoring Images are never displayed on the public verification page.
Webcam Interruption: if your webcam becomes unavailable or is interrupted after a Main Test begins, the test continues. Any missed capture point is represented on the proctoring summary by a placeholder noting that the webcam snapshot was unavailable at that capture point, and your certificate will visibly reflect the missed capture.
Integrity Review: authorized administrators may review the Proctoring Images associated with a test attempt solely for assessment integrity purposes.
Timing and Controls: Main Tests are timed by our servers. Pasting and similar shortcuts are disabled during tests, and one active test session is permitted per account at a time.
Attempt Outcomes: every commenced Main Test consumes one subscription and produces a result and a certificate, regardless of connection loss, browser failure or early abandonment. The test timer is enforced by our servers and continues independently of your connection. Where connection is lost, your result and certificate reflect the last test state received by our servers. If you experience technical difficulties, contact us at info@americanstandardtypingcertificates.com and we may grant additional subscriptions at our discretion.
Integrity Breaches: we reserve the right to withhold, invalidate or revoke a certificate where we reasonably determine that a test was completed by a person other than the account holder, or that the test or platform controls were circumvented or manipulated.
7. PROHIBITED ACTIVITIES
You agree not to engage in any of the following prohibited activities:
Cheating or Fraud: submitting falsified information or having another individual complete a typing test on your behalf.
Impersonation: representing yourself as someone other than the registered account holder when completing a test.
Circumvention: attempting to defeat, manipulate or interfere with proctoring, timing or any other integrity control of the platform, for example by presenting another person or an image to the camera. Declining webcam consent or sitting a Main Test without a camera is not circumvention.
Unauthorized Access: attempting to gain unauthorized access to other user accounts or our systems.
Violation of Laws: engaging in activities that violate any applicable federal, state or local law or regulation of the United States or any other applicable jurisdiction.
Interference: interfering with or disrupting the integrity or performance of our Services.
Harmful Conduct: uploading or transmitting viruses, malware or any other harmful code.
Reselling Services: reselling or redistributing our Services without prior written consent.
Data Misuse: attempting to access, collect or use the personal data of other users in any unauthorized manner.
Certificate Tampering: altering, editing or misrepresenting any certificate or verification page, or presenting another person's certificate as your own.
8. INTELLECTUAL PROPERTY RIGHTS
Ownership: all content, features and functionality on the Services, including text, test passages, graphics, logos, certificate designs and software, are owned by the Company or its licensors and are protected by applicable intellectual property laws.
Limited License: you are granted a limited, non exclusive, non transferable license to access and use the Services for personal, non commercial use. Your certificate may be shared with employers and institutions for legitimate professional purposes.
Restrictions: you may not reproduce, distribute, modify or create derivative works of our content, including test passages, without express written permission from the Company.
9. USER REPRESENTATIONS
By using the Services, you represent and warrant that:
All information you provide is true, accurate and complete.
You will maintain the accuracy of such information.
You have the legal capacity to agree to these Terms.
You are at least 18 years of age.
You will not use the Services for any illegal or unauthorized purpose.
You will be the individual personally completing the typing tests.
You will not engage in any form of cheating or dishonest practices.
You understand that your certificate reflects your personal typing performance and that providing a certificate completed by another individual to a third party, such as an employer, may constitute fraud.
10. PRIVACY POLICY AND DATA USE
We value your privacy. Your personal data, including Proctoring Images captured during Main Tests, is collected and used to administer and verify your typing assessment and maintain your account, as set out in our Privacy Policy at www.americanstandardtypingcertificates.com/privacy-policy. We do not sell your personal data for monetary consideration. Our limited use of analytics and advertising tools is described in our Privacy Policy.
By using the Services, you acknowledge that you have read and understood our Privacy Policy, including its notice that your personal data is stored in Australia and may be processed by service providers in other countries. Webcam capture during Main Tests is subject to the separate consent requested before each Main Test. In the event of a data breach that poses a risk to your personal data, we will notify you in accordance with applicable law. A summary of our Data Breach Notification and Incident Response Plan is available at www.americanstandardtypingcertificates.com/incident-response-plan.
Electronic Marketing. In line with the CAN-SPAM Act, our commercial email messages identify us, include a valid postal or electronic return address and provide a clear way to opt out of future marketing messages. We action opt out requests within 10 business days. Service related communications, such as sign in links and test results, are not marketing messages.
11. THIRD PARTY LINKS AND CONTENT
Our Services may contain links to third party websites or content that we do not control. We are not responsible for the content or privacy practices of any third party websites. We encourage you to review the privacy policies of any third party sites you visit.
12. DISCLAIMERS
As Is Basis: the Services are provided on an as is and as available basis without warranties of any kind, either express or implied, except where such warranties cannot be excluded under applicable law.
No Guarantees: we do not guarantee the accuracy, completeness or usefulness of the Services.
Certificate Recognition: while our certificates are designed to reflect genuine typing performance, we make no representation that any particular employer or institution will accept or recognize our certificates. Acceptance is at the sole discretion of the receiving party. The Virtual Proctoring Summary shows how many webcam snapshots were captured during the test, and a receiving party may take this into account.
Use at Your Own Risk: you assume all risk for any damage that may result from your use of the Services, to the extent permitted by applicable law.
13. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law:
No Liability for Indirect Damages: we will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Services.
Maximum Liability: our total liability to you for any claims arising from the use of the Services shall not exceed the total amount you have paid to us in the six months preceding the claim.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including any mandatory consumer protection law of the United States, or liability for death or personal injury caused by negligence, or for fraudulent misrepresentation.
14. INDEMNIFICATION
You agree to indemnify and hold harmless American Standard Typing Certificates, its affiliates, and their respective officers, directors, employees and agents from and against any claims, liabilities, damages, losses or expenses, including reasonable legal fees, arising out of your breach of these Terms or your fraudulent or unlawful use of the Services, to the extent permitted by applicable law.
15. DISPUTE RESOLUTION
Informal Resolution: Before initiating any legal proceedings, you agree to first attempt to resolve the dispute informally by contacting us at info@americanstandardtypingcertificates.com. We will make reasonable efforts to respond and resolve the matter within 30 days of receipt of your notice.
Formal Dispute Resolution: If the dispute cannot be resolved informally within 30 days, either party may pursue their legal remedies.
Payment Disputes: For disputes relating to payment transactions, the established dispute resolution processes of our payment processors remain available to you in accordance with their respective terms.
16. TERM, TERMINATION AND ACCOUNT DELETION
Term: These Terms remain in full force and effect while you use the Services.
Termination by Us: We may suspend or terminate your account and your access to the Services where we reasonably determine that there has been a material breach of these Terms, fraudulent conduct or cheating. Where appropriate, we will tell you the reason. Upon termination, your right to use the Services will immediately cease. Termination does not affect any rights or obligations that arose prior to termination.
Account Deletion: You may request deletion of your account at any time, as described in our Privacy Policy. You acknowledge that deletion is total and permanent. It removes all of your account data, attempt history, results, transcripts, certificate files and stored PDFs, Proctoring Images and the public certificate verification record. Once the deletion is processed, the verification link for any certificate previously issued to you will return a not found response, and no certificate previously issued to you can be verified by any party. We do not retain a minimum record to preserve the validity of an issued certificate.
17. MODIFICATIONS AND INTERRUPTIONS
Service Changes: we reserve the right to modify or discontinue all or part of the Services at any time without notice.
Interruptions: we are not liable for any unavailability or interruption of the Services, to the extent permitted by applicable law.
Material Changes: where we make material changes to the Services that affect your rights, we will endeavor to provide reasonable notice where practicable.
18. CORRECTIONS
There may be information on the Services that contains typographical errors or inaccuracies. We reserve the right to correct any errors and to update information at any time without prior notice. This does not affect the validity of any certificate that has already been issued.
19. ELECTRONIC COMMUNICATIONS, TRANSACTIONS AND SIGNATURES
By using the Services, you consent to receive electronic communications from us. You agree that all agreements, notices, disclosures and other communications we provide electronically satisfy any legal requirement that such communications be in writing. Service related communications, such as account sign in links, test results and security notices, are necessary to the delivery of the Services.
20. GOVERNING LAW
These Terms and any disputes arising in connection with them or the Services are governed by and construed in accordance with applicable law. Nothing in these Terms limits any rights you may have under the mandatory consumer protection or privacy laws of your jurisdiction.
21. MISCELLANEOUS
Entire Agreement: these Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the Services and supersede all prior agreements and understandings.
Severability: if any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Waiver: our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
No Assignment: you may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to a successor to our business, provided your rights under these Terms are not reduced.
